ACB produces charge-sheet against ex-forester in Kashmir

Srinagar, Aug 27 (Agency) The Anti Corruption Bureau (ACB) has produced a charge-sheet against a former forester in Soil Conservation department in a Disproportionate Assets case in Kashmir valley. A spokesperson of ACB said that the bureau produced the charge-sheet in case FIR No 11/2017 u/s 5 (1)(d),(e) r/w section 5(2) of PC Act Samvat-2006 of ACB SBG Srinagar against one Bashir Ahmad Shah, a resident of Garoora in Bandipora. “The brief facts of the case are that a verification was conducted by the ACB Kashmir into the allegations that Shah, the then Forester, who was later posted as Zonal Soil Conservation officer (Soil Conservation department J&K) has amassed huge wealth disproportionate to his known sources of income,” he said.

It was revealed that Shah had purchased land (plot No 64) at Bagh-e-Mehtab Housing Colony Srinagar and another plot at Zubairabad Sujwan Road Jammu and has constructed two palatial houses on these plots. “Investigation further revealed that he had amassed the property and incurred huge expenditure during the period 1980 to 2009 which has been found disproportionate to his known sources of income,” he said. He said the aforesaid omissions and commissions on the part of Shah led to the registration of the instant case. “The assets discovered and attributed to the accused public servant are a house at Plot No 64 Bagh-e-Mehtab Housing Colony, Srinagar. Shah had purchased a plot measuring 7 marlas under khasra No 356/min situated at Zubair Abad Sujwan Bhathandi Jammu through a “tahreer Nama and Baian Halfi” dated February 27, 2007 in the name of his second wife Rumysa,” he said.

He said during investigation it surfaced that the accused has purchased two kanals of land at Chari Sharief jointly with his father in-law in year 1996 and later on constructed a house on land jointly with his father in-law. “During investigation, the land measuring one Kanal at village Charar–i-Sharief is recorded in the name of accused Shah, where a two storyed residential house is exists. The brother-in-law of the accused is residing in the house currently,” he said. On the strength of facts and circumstances, together with cogent and clinching evidence brought on record, the investigation has established the commission of offences made by Shah. “The accused public servant has retired on superannuation on January, 3, 2019, as such the necessary sanction for launching of prosecution was required,” he said. The next date of hearing is fixed on October 18, 2021.
