SC rejects plea for registering case against UP CM for alleged objectionable speech

New Delhi, Jan 23(Bureau) Supreme Court on Monday in its order rejected a petition filed by a resident of Mau district, seeking direction for registering a case against Uttar Pradesh Chief Minister Yogi Adityanath for an alleged objectionable speech during an election campaign in Rajasthan’s Alwar in 2018, after the bench noted that “such litigations are only for page 1 (of newspapers).” A two-judge bench of the Supreme Court, headed by Justice B R Gavai and also comprising Justice Vikram Nath, dismissed the petition filed by Naval Kishor Sharma, of Uttat Pradesh’s Mau district. “Such litigations are only for page 1 (of newspapers). Dismissed,” the bench said, and rejected the petiton filed by Sharma.

The petitioner had moved the apex court against an order of the Allahabad High Court which had not only dismissed his plea but also imposed a fine of Rs 5,000 on him. Sharma, in his pettiton filed before the Supreme Court, said that the UP CM, Adityanath, had on November 23, 2018, in an election speech in Alwar in Rajasthan, hurt his religious sentiments. Before moving to the Supreme court, the petitioner had filed a complaint against the speech before the district court of Mau, which was rejected. He had then filed a revision petition before a higher court, which too was dismissed on the ground of territorial jurisdiction. Then Sharma, also moved the Supreme Court seeking registration of case against Adityanath, but the SC also declined his plea.
