Bengaluru, May 19 (Agency) Karnataka State Human Rights Commission has ordered a police officer to pay compensation of Rs 75,000 to a Japanese national for illegally arresting him and deporting him to his country without following the procedures. “The arrest of the complainant was clearly illegal and without authority of law by the then PSI Hanumantharayappa. The commission in detail leads to the conclusion that no proper procedure was followed in this case. And the arrest and detention of the complainant was illegal and violated his human rights. Hence, it is necessary to compensate the complainant for the illegality committed by RT Nagar Police Sub Inspector Hanumanthrayappa who was expected to protect the law and order and safeguard the rights of the people,” the (KSHRC) order read. The Japanese national Hirotoshi Tanaka was detained after a false case was filed against him, but later a court quashed the FIR.
After getting the verdict in his favour, Tanaka registered a complaint before the KSHRC in December 2020, alleging that PSI Hanumantharayappa had harassed him and due procedures of law were not followed. Before he could get justice, Tanaka’s visa expired and the police prepared to deport him. In March last year, he went to the JC Nagar ACP office and “stole” a chair and brought it to his room and sent the photographs of it to the police so that they could book a case of theft against him and extend his stay in India to fight the case against the PSI. KSHRC chairperson Justice DH Waghela also asked the authorities to issue appropriate guidelines to police officers for dealing with cases involving foreign nationals or illiterate persons. Tanaka, who is jobless in Japan, wants to visit India and file a criminal case against the PSI for harassing him. He said he wants to reunite with his girlfriend whom he missed for a year without committing any mistake.
